1. Acceptance of Terms
By requesting, confirming, or paying for a booking with Thrive Property Co (“we”, “us”, “our”), the Responsible Organisation (“RO”) agrees to these Terms and Conditions.
If a representative, case worker, or agent (“Responsible Person” or “RP”) makes the booking, they confirm they have authority to act on behalf of the RO.
Acceptance occurs when:
• a booking is confirmed in writing, or
• any invoice is paid (in full or part).
2. Our Service
We provide safe, fully furnished temporary accommodation with utilities connected and flexible lengths of stay. “House” includes homes, villas, and townhouses. All properties are for residential use only.
3. Responsibilities of the Responsible Organisation
The RO:
• remains responsible for all occupants at all times
• appoints an RP as the primary contact
• must notify us of any change in RP
The RO is liable for all costs, damages, and obligations under this agreement.
4. Children and Young People
Where children or young people are placed, the RO confirms that:
• the placement is lawful and appropriate
• all required approvals are in place
• supervision is arranged at all times
• all duty of care obligations remain with the RO
We do not assume duty of care for occupants.
5. Safety, Suitability & Risk
The RO is responsible for assessing placement suitability, managing behavioural risks, and ensuring the safety of occupants and the community.
We may decline or end a placement if it presents an unacceptable risk.
6. Use of the Property
Properties must be used for quiet residential purposes. The RO must ensure occupants and visitors:
• avoid nuisance or disturbance
• do not engage in illegal activity
• do not damage the property
• comply with all laws
Parties, excessive noise, and anti‑social behaviour are not permitted.
7. Immediate Termination
We may require occupants to vacate immediately if:
• safety is at risk
• illegal or anti‑social behaviour occurs
• the placement becomes unsuitable
• these Terms are breached
The RO must arrange immediate removal. No refund applies in these circumstances.
8. Payment Terms
• Payment is required in advance unless agreed otherwise
• Invoices must be paid by the due date
• Ongoing invoices are due within 7 days
We may suspend services for non‑payment and charge reasonable recovery costs.
Payment of any invoice confirms acceptance of these Terms.
9. Cancellations & Changes
• Minimum 72 hours’ notice is required to avoid charges
• Late cancellations may incur fees
• Early departures may still attract minimum charges
10. Minimum Stay
A minimum stay may apply. Shorter stays may still be charged at the minimum rate.
11. Property Condition & Damage
A condition report will be completed before occupancy.
The RO is responsible for:
• all damage, loss, or destruction
• actions of occupants or visitors
We may arrange repairs, replace items, and charge administrative costs. Charges may continue until the property is fully restored.
12. Urgent Repairs
We may undertake urgent repairs without prior approval where safety is at risk. All costs will be charged to the RO.
13. Cleaning
Properties must be left clean and tidy. Additional cleaning costs may apply where required.
14. Insurance
The RO must maintain appropriate insurance, including public liability and any placement‑related cover. We do not insure occupants’ personal belongings.
15. Indemnity
The RO indemnifies us against all claims, losses, damages, liabilities, and expenses arising from:
• the placement
• actions or omissions of occupants or visitors
• any breach of these Terms
16. Limitation of Liability
To the extent permitted by law, our liability is limited to the total fees paid for the booking.
17. Privacy & Information
We may collect and store personal information for operational, safety, and record‑keeping purposes, including:
• occupant details
• incident reports
• communications and records
The RO confirms it has obtained all necessary consents.
18. Recording & Surveillance
The RO is responsible for ensuring compliance with all surveillance and recording laws.
19. No Residential Tenancy
This agreement provides temporary accommodation only. It does not create a residential tenancy, lease, or exclusive possession.
20. Incident Reporting
The RO must notify us immediately of:
• incidents involving occupants
• property damage
• police involvement
• safety concerns
21. Property Substitution
If a property becomes unavailable, we may offer alternative accommodation of a similar or higher standard.
22. Force Majeure
We are not liable for delays or failure to perform due to events beyond our control, including natural events, emergencies, or property damage.
23. Regional & Remote Properties
These clauses apply to any property classified by Thrive Property Co as regional or remote.
23.1 Limited Support
Support is during business hours only and may be delayed due to location.
23.2 On‑Site Responsibility
The RO manages all on‑site matters, including access, occupant management, and repair coordination.
23.3 Damage Notification
The RO must notify us of any damage or safety concerns within 2 business days.
23.4 Quotes
At least one written quote must be provided within 7 business days.
23.5 Repairs
All repair works must be approved by Thrive Property Co prior to commencement and completed to a standard reasonably acceptable to Thrive Property Co.
Thrive Property Co and the RO agree to work collaboratively in relation to all property damage repairs and rectification works. The RO acknowledges that Thrive Property Co maintains specific property presentation, safety, and quality standards across its portfolio, and all repair works must be completed to a standard reasonably acceptable to Thrive Property Co.
Where repair works are arranged by the RO, Thrive Property Co reserves the right to:
• Review and approve quotes, materials, finishes and contractors
• Request alternative quotes where works are not considered appropriate
• Require additional rectification where completed works do not meet the required standard
Repairs must commence within 21 days of the damage being identified unless otherwise agreed in writing due to extenuating circumstances.
Where repairs are delayed without approval, Thrive Property Co reserves the right to appoint its own contractors, recover all associated costs from the RO, and continue charging accommodation fees until repairs are completed.
23.6 Delays
If repairs are delayed without approval, we may appoint contractors and continue charging accommodation fees until repairs are completed.
23.7 Urgent Repairs
The RO must arrange immediate make‑safe actions where safety or property is at risk.
23.8 Escalation of Damage
Any additional damage caused by delays remains the RO’s responsibility.
23.9 Early Termination Due to Damage
If damage results in early termination, the remaining booking is non‑refundable.
23.10 Contractor Access
The RO must arrange access and ensure cooperation for repair works.
23.11 Costs
The RO is liable for all repair, travel, call‑out, remote service, and administrative costs.
23.12 Utilities
We are not liable for utility interruptions outside our control.
23.13 Security
The RO is responsible for securing the property and managing access.
23.14 Communication
The RO must maintain regular communication regarding incidents, repairs, and delays.
23.15 No Reliance
The RO acknowledges that immediate or on‑site support is not provided in regional or remote locations.
24. Entire Agreement
These Terms form the entire agreement and replace all prior discussions.
25. Variations
We may update these Terms from time to time. Continued use of our services means acceptance of updated Terms.
26. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
